Evidence Withheld and U.S. Army Ranger Michael Behenna Goes to Prison

MILITARY PROSECUTORS WITHHOLD EVIDENCE; ARMY RANGER GOES TO PRISON FOR 25 YEARS (recently reduced to 15 years) FOR SHOOTING AL QAEDA OPERATIVE

On March 20th, 2009, Army Ranger 1st Lieutenant Michael Behenna was sentenced to 25 years in prison for killing Ali Mansur, a known Al Qaeda operative while serving in Iraq. Mansur was known to be a member of an Al Qaeda cell operating in the lieutenant’s area of operation and was suspected to have organized an attack on Lt. Behenna’s platoon in April 2008 which killed two U.S. soldiers and injured two more. Army intelligence ordered the release of Mansur and Lt. Behenna was ordered to return the terrorist to his home.

During the return of Mansur, Lt. Behenna again questioned the Al Qaeda member for information about other members of the terrorist cell, and financial supporters. During this interrogation, Mansur attacked Lt. Behenna, who killed the terrorist in self-defense. The government subsequently prosecuted Lt. Behenna for premeditated murder.

Not only is this a miscarriage of justice on the behalf of Lt. Behenna, who was acting to prevent further loss of life in his platoon, it is demoralizing to the U.S. troops who continue to fight on behalf of the freedom and security of our nation. Whether it is U.S. border patrol agents, members of the armed forces, or FBI agents, no individual who is serving on the frontlines in the War on Terror should be so blatantly mistreated.

We urgently need your help to correct this terrible wrong against a loyal and faithful soldier. Please contact your congressman and ask them to intervene on behalf of 1LT Behenna. Below is a brief recap of the relevant aspects of Lt. Behenna’s case.

September 2007: 1st Lieutenant Michael Behenna deployed to Iraq for his first combat experience.

April 21, 2008: Lt. Behenna’s platoon was attacked by Al Qaeda operatives. The attack resulted in death of two of Lt. Behenna’s platoon members, two Iraqi citizens, and wounded two additional soldiers under Lt. Behenna’s command.

May 5, 2008: Known terrorist Ali Mansur was detained at his home for suspected involvement in the attack on Lt. Behenna’s platoon.

May 16, 2008: Army Intelligence orders the release of Mansur.

Lt. Behenna, who lost two members of his platoon just weeks earlier, was ordered to transport Mansur back to his home.

Lt. Behenna attempts a final interrogation of Mansur prior to his release.

During the interrogation, Behenna is attacked by Mansur and is forced to defend himself. During the altercation, the terrorist is killed.

Lt. Behenna failed to properly report the incident.

July 2008: The U.S. Army charges Lt. Behenna with premeditated murder for the death of Al Qaeda operative and terrorist Ali Mansur.

February 23, 2009: Lt. Behenna’s trial begins.

Government and defense experts agree on the trajectory of the bullets killing Mansur.

Prosecution expert Dr. Herbert MacDonnell initiated contact with defense attorneys explaining his agreement with the testimony of Lt. Behenna and his presentation to prosecutors supporting Lt. Behenna’s version of events.

Dr. MacDonnell is not called to testify in the case and instead is sent home. Just before leaving the courthouse he picks up his coat from the prosecution room and says to the three prosecutors (Megan Poirier, Jason Elbert, and Erwin Roberts), ‘The explanation that Lt Behenna just testified to was the exact same scenario I told you yesterday. Lt Behenna is telling the truth.’

Jack Zimmermann, defense counsel, asks prosecutors if they have any exculpatory evidence that should be provided to the defense (referring to Dr. MacDonnell’s demonstration). Prosecutors deny having any such evidence despite having been told by their own expert witness that Lt Behenna’s explanation was the only logical explanation.

Prosecutors withholding of this evidence allowed them to argue that Lt. Behenna executed Ali Mansur while seated when the forensic experts, including Dr. MacDonnell, agree that Ali was standing with his arms outstretched when shot.

Lt. Behenna is convicted of unpremeditated murder and assault by a military panel of seven officers, none of whom had combat experience.

Dr. MacDonnell contacts prosecution requesting that the information provided in his demonstration be given to the defense.

Prosecutors provide such information after a verdict was rendered, but prior to sentencing.

At the request of the presiding judge, Dr. MacDonnell provides his information to the court via telephone.

The judge orders both sides in the case to file briefs relating to a possible mistrial.

After reading the briefs the judge set an additional hearing and ordered additional briefs, including one from the defense requesting a new trial.

On March 20, the judge denied defense motions to declare a mistrial and to order a new trial.

Lt. Behenna was paraded in handcuffs through the Nashville airport, the Milwaukee airport, and the Kansas City airport enroute to Fort Leavenworth Prison.

Lt. Behenna’s attorneys are appealing the verdict.

Lt. Behenna is currently serving a 15-year sentence (the 25 year sentence was reduced five years by the commanding general of 101st Airborne and reduced another five years by the Army Clemency Board. The earliest he would be eligible for parole is after serving a third of his sentence. Without parole or a new trial Lt. Behenna will get out of prison for the shooting an Al Qaeda terrorist in self defense when he is 40 years old.

1st Lieutenant Michael Behenna was an excellent officer. He received his call to serve his country while attending the University of Central Oklahoma. He is from a family of public servants, his mother being an Assistant United States Attorney and his father a retired Special Agent with the Oklahoma State Bureau of Investigation. He has served the Army and the United States with honor and dignity. To sacrifice the life of this Oklahoma soldier over the death of a known terrorist, is a breech of faith with all who are serving our country.

My heart weeps to see our American soldiers, such as Michael Behenna, being arrested and charged for defending themselves, for fighting the enemy, which is their job, and I really want this American hero exonerated. I want all charges dropped. I want both the federal government and the military to issue public apologies and his full military rank and honors restored immediately. I want the prosecutors who perpetrated this grave injustice to face charges of their own.

Stand for the U.S. Constitution & America with Mike Lee

Mike Lee, U.S. Senatorial candidate and constitutional scholar, will be speaking at a rally this evening and you're invited. It is an amazing opportunity to hear one of the greatest constitutional scholars of our generation.

I've heard Mike speak about the U.S. Constitution, America and the situation we find ourselves in many times. He has many wise solutions to the problems we face. And he has given me hope. When hope becomes present, a wise person seeks the source and does all they can to keep that source burning brightly...in this case, keeping the light of freedom burning brightly, and it does that in Michael S. Lee.

For Mike, the solutions to the problem we face are outlined on his website.

In addition, I have posted on my blog the reasons why I am supporting Mike Lee in his bid for Senator Bennett's seat. You can read more about that at Why I Support Mike Lee.

In the meantime, I hope to see everyone in Utah County there tonight. It is always inspiring and always leaves me with a brighter hope for America.

Why Do I Support Mike Lee?

Since Mike Lee threw his hat into the Utah senatorial race, people have been asking me why I support him. They aren't trying to be rude, well not all of them, some really want to know. The first time I was asked that question I had to stop for a second, because why Mike should be Utah's next senator is so patently obvious to me.

The first reason is rather intangible, from the first time I heard Mike speak about the U.S. Constitution hope infused my soul. This was the first time it had done so since November 4, 2009. When hope becomes present, a wise person seeks the source and does all they can to keep that source burning brightly...in this case, keeping the light of freedom burning brightly, and it does that in Michael S. Lee.

Now on to the tangible reasons, and they are many:

* Mike Lee is a man of integrity, courage and strength. He is unafraid of anyone in Washington, D.C. As a law clerk of U.S. Supreme Court Justice Samuel A. Alito, he worked on some of the most critical cases in our nation. He has stood, even in uncomfortable places, for what he believes in no matter how unpopular that stance may have been.

* Mike Lee has a deep, abiding love and respect for the U.S. Constitution. The topic of conversation over the dinner table growing up, as the son of Rex Lee, former Solicitor General, Mike learned of the Constitution nightly as the family members discussed one of the most profound and divinely inspired documents on the face of the earth, ever. Mike has spent his career as a constitutional attorney defending the U.S. Constitution at all levels of America's judicial system. He carries the Constitution in his suit coat pocket and will pull it out to quote clauses, although he seems to have the whole memorized, so he doesn't really need the physical text of the Constitution.

Mike is in direct contrast to the incumbent (Bob Bennett) in this matter, who has publicly stated: "I would be careful about holding candidates to their oath of office because the Constitution can be interpreted many, many ways."

When Mike asked Senator Bennett if he'd measured TARP against the U.S. Constitution for its constitutional viability, Senator Bennett answered, "Well, I haven't read the Constitution in a long time."

It should be obvious to anyone why I've chosen Mike Lee on this matter. There is no one in the race right now who knows and understands the U.S. Constitution better than Mike Lee.

Reagan White House staffer, Paul Skousen, son of the late W. Cleon Skousen (author of The 5,000 Year Leap) has publicly endorsed Mike Lee: “To make a difference in today’s hostile Washington environment you’ve got to have in-your-face experience, in-depth knowledge and understanding, and a firm grip on the principles of freedom locked into our Constitution,” he said. “Mike Lee has demonstrated all of that—experience, understanding and application. That’s why I’m endorsing Mike Lee.”

* Mike Lee strongly advocates a limited federal government and strong states rights. His plan for returning America to her former glory, for he loves this nation dearly, and like me, believes she was created for divine purposes, is simple and straightforward:

-- End deficit spending: Deficit spending facilitates the continuing growth of the federal government. It is far too tempting to shift the cost of today’s federal expansion to future generations. Until we require Congress to operate under a balanced budget, that expansion will continue. A balanced budget amendment is essential to restoring the original, proper role of the federal government.

-- Strengthen National Security But Stop Nation Building: A core constitutional function of the federal government is to “insure domestic tranquility” by protecting our country. We must continue to develop sophisticated, cutting-edge tools to defend our citizens from threats of terrorism. But our focus must be on rebuilding our own nation. We should not and cannot afford to continue the quest for nation-building.

-- Reform the Tax System: With 50% of wage earners paying little or no taxes, too many voters have no “skin in the game”—and no reason to question new government programs that are funded by the real taxpayers. Until we reform the tax code to give all Americans a stake in their government (through a flat tax), Congress will continue to adopt new entitlements, new bailouts, and new relief programs.

-- End the Era of the Lifetime Politician: The runaway growth of the federal government will continue as long as we retain a system that assures the existence of lifetime politicians. A career member of Congress inevitably will come to believe that that body has the answer to all social problems. The Constitution should be amended to limit service in each house of Congress to 12 years.

It's a solid plan and one I support wholeheartedly.

* When Mike Lee announced his intention to run for the U.S. Senate and Bob Bennett's seat, I asked him in front of those who had endorsed him and all the press, "Mike, do you have the spine, the backbone to go back to Washington, D.C. and take every single law and piece of legislation in the pipeline and measure it against the U.S. Constitution? And, if you find any of those things violating the U.S. Constitution, will you promise to put your efforts into the repealing of those laws and the defeat of those legislations?"

His answer was simple, "Yes. I have the backbone to do that. I cannot promise it will be easy or quick, in fact it will be very difficult, but I can promise that I will do that. I will use the U.S. Constitution as my measuring stick."

* When asked if he would vote on legislation he hadn't read, he quoted James Madison's opinion on voluminous legislation, "It will be of little avail to the people, that the laws are made by men of their own choice, if the laws be so voluminous that they cannot be read, or so incoherent that they cannot be understood; if they be repealed or revised before they are promulgated, or undergo such incessant changes that no man, who knows what the law is today, can guess what it will be tomorrow. " Mike stated his default vote would be "no" if he was not given reasonable time to read the legislation before him.

I could go on and on, but it is enough for me to know that he is a wise, experienced, knowledgeable man who has immersed himself in the U.S. Constitution, tempered himself with integrity, bravery and honor, and has remained true to his values and beliefs throughout his legal career. Mike Lee is a man I sincerely like and have come to respect.

These are but a few of the reasons I support, and publicly do so, Mike Lee for the U.S. Senate.

Contract from America - The Tea Party Moving Forward

The tea party movement has been an interesting one to behold. I have been in the thick of it from the beginning and it has now grown to 39,000,000+ strong and our numbers are only increasing. While splinter groups formed across the nation, Tea Party Patriots has moved forward with action instead of just words. Borrowing from Newt Gingrich's wildly successful 1980's "Contract with America," the Tea Party Patriots have created the Contract from America.

"The Contract from America is a grassroots-generated, crowd-sourced, bottom-up call for real economic conservative and good governance reform in Congress. The Contract from America initiative was developed within the decentralized tea party and 912 movements. Ryan Hecker, a Houston Tea Party Society activist, developed the concept of creating a grassroots-generated call for reform prior to the April 15, 2009 Tax Day Tea Party rallies."

Go here and choose the issues you feel are the top 10 priorities for America. Choose wisely, but please go choose.

And a note I wish to strongly emphasize. The Tea Party movement, as it has coalesced into a force to be reckoned with, has largely ignored God, focusing instead on America's wildly out of control federal government. In focusing on the U.S. Constitution, which includes the inviolate Bill of Rights, they do stand for "freedom of religion." But as a point I feel needs to be strongly stressed, we here in Utah will NEVER remove God from the equation. Along with Governor Palin, we pray for divine intervention in this oncoming train wreck we now identify as America vs. the 111th Congress.

For this tea partier, I believe in God and the divine purposes of America, as well as the sanctity of marriage. And, I am staunchly pro-life.

None of these principles will ever leave me or take a back seat in my fight for America. The words of "God Bless America" are ringing in my head right now:

While the storm clouds gather far across the sea,
Let us swear allegiance to a land that's free.
Let us all be grateful for a land so fair,
As we raise our voices in a solemn prayer:

God bless America, land that I love,
Stand beside her and guide her
Through the night with a light from above.
From the mountains, to the prairies,

And I echo these words, God bless America, my home sweet home. For without God and the U.S. Constitution, we're just another nation playing at being a country. America is the last bastion of freedom in the world, we cannot give up this fight. If we will stand with those legislators who have chosen to fight back with 10th Amendment rights and lawsuits, we will effect a sweeping change in November.

Choose candidates who:

... love and support the U.S. Constitution.
... who believe in God and adhere to the principles of Christianity.
... believe in limited government.
... who believe in fiscal responsibility.
... believe in, and would fight to the death for, America.
... respect, support and care for our U.S. military.
... believe in a free market system.
... have common sense.
... have a spine of steel and fear not the battle with the traitors in Washington, D.C.
... not only have a value system, but live up to it.

And so you may be asking, where are these stellar candidates you speak of Candace? Who have you chosen to publicly endorse for the upcoming political races?

I'm torn between Sarah Palin and Mitt Romney for the presidential race. I like Sarah Palin and all that she stands for, she is a strong, principled woman. Mitt Romney is a little too liberal for my taste, but I know him to have a deep love for the U.S. Constitution, a brilliant mind when when it comes to the economy, a deep love for America and the Founding Fathers, and I know him to be a man of integrity and courage. So what's my problem with him? He endorsed Bob Bennett. And what's my issue with Sarah Palin? She endorsed John McCain.

Anyone know if Michele Bachmann is planning on running?

SALT LAKE CITY - Governor Gary R. Herbert has signed HB67, which requires the Utah Department of Health to carefully analyze federal healthcare reform efforts prior to implementation and to report to the Legislature potential impacts on Utahns and to the state's own healthcare reform efforts.

"States must take reasoned, proactive steps to keep themselves in control of their own reform efforts," Governor Herbert said. "With last night's passage of federal healthcare reform legislation, it is more important than ever that we stand up to the federal government. States simply cannot afford an unfunded mandate of this magnitude that creates yet another unmanageable federal entitlement program."

"In addition, every Utahn should be concerned about the impact of this legislation on our economic recovery, the chilling effect on job creation for small businesses, and the added burden to an already unacceptable and growing national debt."

One possible response to the expected signing of the legislation by President Barack Obama is a lawsuit against the federal government, such as that proposed Monday by Utah Attorney General Mark Shurtleff.

"In light of the concerns shared by many people in Utah and around the country, it is entirely appropriate that the Attorney General and his counterparts across the nation consider every option on this issue," Governor Herbert said. "A lawsuit puts into action concerns over a federal government overreach that is unprecedented and possibly unconstitutional."

Of particular concern to the Governor is the possibility that the federal legislation will supersede Utah's own healthcare reform efforts, which have been ongoing for several years and are beginning to show great promise toward increasing transparency, access and choice in Utah's healthcare system.

"I have consistently said that one-sits-fits-all federal solutions do not address states' unique circumstances, on this issue or any others," Governor Herbert said. "We must recognize the differences that exist throughout the country and develop customized solutions to healthcare reform that addresses the needs of our citizens."

UTAH WILL JOIN LAWSUIT OVER HEALTH CARE REFORM

Utah will join several states in a lawsuit challenging the health care reform legislation passed by the U. S. House of Representatives Sunday evening.

“This health care reform bill includes an unprecedented mandate that requires every U.S. citizen to buy health insurance or face a penalty. This mandate and other provisions violate the U.S. Constitution and infringe on individual and state rights,” says Attorney General Mark Shurtleff. “This lawsuit will help make sure the rights and the interests of American citizens are protected."

The Attorneys General of Utah, Alabama, Florida, South Carolina, Nebraska, North Dakota, Pennsylvania, South Dakota, Texas and Washington have all agreed to file the lawsuit if the President signs this bill into law. Other states are expected to join in the litigation.

Let me be absolutely clear here. The 60% of Americans who opposed yesterday's health care legislation do NOT oppose REAL healthcare reform. Remember that!

The Thorn
